Medico-legal aspects of male ritual circumcision in Europe - 24/03/25

Abstract |
This paper analyzes and compares the current legislation in major European countries regarding male ritual circumcision (MRC). European legislation on MRC varies significantly, despite the Parliamentary Assembly of the Council of Europe (PACE) called on member states to define medical and health-related conditions for MRC while respecting children’s rights. These significant disparities reflect diverse cultural and religious contexts. The topic is controversial and raises many ethical and medico-legal doubts. The study emphasizes the need for a balanced approach that respects both children's rights and the cultural and religious identities of communities. Establishing minimum standards for procedural safety and informed consent, while allowing for cultural and religious nuances, is crucial. Future research should explore the impact of current regulations on public health outcomes and community relations, as well as the potential for broader European initiatives to address the medico-legal complexities of MRC. Collaborative dialogue among stakeholders, including religious communities, medical professionals, and policymakers, is essential to develop inclusive and effective solutions.
